Terms of Service

1. Acceptance of Terms

By accessing or using the PostQ platform, website, APIs, and related services (the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

PostQ provides a quantum-safe cryptography control plane that enables organizations to discover, migrate, and enforce post-quantum cryptographic standards across their cloud infrastructure. The Service includes the Quantum Risk Scanner, Hybrid Signing API, PQ Vault, policy enforcement engine, and observability dashboard.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep your account information current.

4. Organizations and Access

The Service supports multi-tenant organizations. Organization owners and admins may invite members, assign roles (owner, admin, member, viewer), and manage access to scans, assets, policies, and settings. You are responsible for managing access within your organization and ensuring that members comply with these Terms.

5. Acceptable Use

You agree not to:

  • Use the Service to scan targets you do not own or have authorization to scan
  • Attempt to access, tamper with, or use non-public areas of the Service
  • Use the Service to violate any applicable law or regulation
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to transmit malware or conduct denial-of-service attacks
  • Resell or redistribute access to the Service without our written consent
  • Use automated means to scrape, crawl, or extract data from the Service beyond what the API permits

6. Scan Targets and Authorization

You represent and warrant that you have proper authorization to scan any target (URL, repository, cloud account, or cluster) you submit to the Service. PostQ is not responsible for any unauthorized scanning activity conducted through your account. You agree to indemnify PostQ against claims arising from unauthorized scans.

7. Intellectual Property

The Service, including all software, documentation, designs, and content, is owned by PostQ and protected by intellectual property laws. You retain ownership of your data, including scan results and configurations stored within your organization. You grant PostQ a limited license to process your data solely to provide the Service.

8. API Usage

Access to the PostQ API is subject to rate limits and usage quotas as described in our documentation. We reserve the right to throttle or suspend API access if usage exceeds reasonable limits or violates these Terms. API keys are confidential and must not be shared publicly.

9. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform scheduled maintenance with reasonable advance notice. We are not liable for downtime caused by factors outside our control, including third-party service outages, network failures, or force majeure events.

10. Limitation of Liability

To the maximum extent permitted by law, PostQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to PostQ in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. PostQ does not warrant that the Service will be error-free, that scan results will be complete or accurate, or that any specific cryptographic vulnerability will be detected. You acknowledge that quantum computing timelines and cryptographic standards are evolving, and PostQ’s assessments reflect current knowledge.

12. Termination

You may close your account at any time through the settings page. We may suspend or terminate your account if you violate these Terms. Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Delaware.
